1. Introduction

1.1 By accessing and using our website, and other websites, mobile applications and services made available under the neighbourhoodpaper.com header, which we refer to collectively as ‘Our Sites’, you agree to be bound by these Terms of Use.

1.2 This website is owned and operated by Moth Projects Creative Pty Ltd, (ABN: 35 609 550 870). When the words ‘us’, ‘our’ or ‘we’ are used in these Terms of Use it means Moth Projects Creative Pty Ltd. When the words ‘ you’ or ‘your’ are used it means you as a user of any of Our Sites.

1.3 Please read these Terms of Use together with our Privacy Policy.

1.4 We may update these Terms of Use from time to time so we recommend you review this page regularly and, in particular before providing any personal information to us and/or purchasing any products or services.

2. Intellectual Property

2.1 Our Sites contain material which is our intellectual property and/or the intellectual property of individual contributors who have licensed material to us be published on Our Sites. You may only use that material as set out in the Terms of Use.

2.2 The NEIGHBOURHOOD trademarks belong to us. We do not grant any licence or right to use those trademarks and you must not use or reproduce them in any way without our written consent.

3. Using Our Sites

3.1 Much of the content on Our Sites can be accessed by you free of charge and without registration.

3.2 To access some content and/or purchase some products and services we will ask you to register with us by providing certain information about you. We may also ask you to provide certain security information such as a username and password. We will use this information to create your NEIGHBOURHOOD account and keep it secure. You must keep your account log in details secure, not disclose them to anyone else, and notify us as soon as possible if you become aware of any unauthorised possession or use of those details.

3.3 Subject to any registration requirements, you may do the following with content on Our Sites for your personal, non-commercial use only:

(a) view pages and download pages;
(b) print pages;
(c) stream audio and video files; and
(d) share content by posting links to social media platforms such as Twitter, Facebook and Instagram.

3.4 Except as permitted in Section 3.3 you must not otherwise use, reproduce, sell, licence, distribute or otherwise exploit any content on Our Sites.

3.5 We want you to share your experience and encourage others to experience Our Sites. If you have signed up to receive our newsletter, you may redistribute it in print and/or electronic form to any person on a non-commercial basis.

4. Respecting Our Sites

4.2 We welcome and encourage thoughtful and lively discussion, questions and comments on our social media platforms. We will not accept trolling, or personal abuse of anyone. We will remove any content that we consider abusive, intimidating or harassing, defamatory, in breach of copyright, vilification, or otherwise unlawful.

5.1 Some content on Our Sites is suitable for people of any age. Some content may be unsuitable for children or anyone under the age of 18.

5.2 We recommend parents/guardians and others responsible for children and young people take steps to protect them in relation to unsuitable online content including visiting https://www.esafety.gov.au/esafety-information.

6. Advertisers

6.1 Our Sites contain third party advertising and promotional material. We do not endorse any advertiser or their products or services.

6.2 If an advertisement on any of Our Sites contains offers which you can accept by going to the advertiser’s website, we are not liable for any products or services you purchase through that website.

7.1 Our Sites may contain links to other websites or services operated by others. We do not control these websites or services and are not liable for their content. We recommend you check their privacy polices and terms and conditions.

8. Contributions

8.1 If we allow you to contribute material to any of Our Sites by way of comments or other text, photographs, video or audio, you confirm that any such material is owned by you, and does not infringe the copyright or other rights of anyone. You will retain copyright in that material but grant us the right to use that material in any way we want in all media worldwide.

9. Disclaimer and Liability Limitation

9.1 Any information on Our Sites is general information only, and is provided purely for the convenience of users. Information contained in Our Sites has been provided without taking into consideration the personal circumstances of any user; the information is not a substitute for you obtaining professional advice in relation to your specific circumstances.

9.2 We will not be liable for any loss, damage, costs or expense, whether direct, indirect, incidental, special and/or consequential including loss of profits, incurred by you, or claims made against a user or any third party which result from the use of the website or reliance on any information on the website.

Any representations, guarantees, and warranties, other than those expressly set out in these Terms of Use, are excluded, to the extent only that exclusion is permitted under the Australian Consumer Law and any other applicable law. Any other exclusion of liability set out in these Terms of Use are relied upon by us only if and to the extent such exclusion is permitted under the Australian Consumer Law.

10. Termination or Suspension

10.1 You may terminate registration of your account with Our Sites by sending an email to hello@neighbourhoodpaper.com.

10.2 If we believe that you have not complied with these Terms of Use, we may, at our discretion, suspend or terminate your access to the registration areas of Our Sites immediately and without prior notice. We may terminate your registered account, at our discretion, by emailing you confirmation of that at the address you have registered.

11. Governing Law

11.1 These Terms of Use are governed by the law of New South Wales, Australia and you agree to submit to the non-exclusive jurisdiction of New South Wales courts.
